Rise Terms of Service

Effective date: [EFFECTIVE DATE]

These terms are an agreement between you and [BUSINESS LEGAL NAME] ("we", "us") for using Rise at rise.potesco.io. By using Rise, you agree to these terms and to our Privacy Policy and Refund Policy.

1. What Rise is

Rise helps fastpitch softball coaches chart bullpens (ball or strike), track each pitcher's progress over time, and share it with players and parents. It isn't a radar gun or a medical tool.

2. Who can use Rise

  • Coaches must be at least 18 [or the age of majority where they live] to create an account.
  • Players and parents use Rise only through an invite link from a coach, or a share link the coach has turned on.
  • Players under 13 (or with no birth date) can get a login only after a linked parent has given consent in Rise and approved that login. Otherwise their coach, or a parent with a parent login, logs for them. Players 13 and over can get a login by coach invite.
  • Parent logins. Parents can run at-home bullpens for their own player (log sessions, sets and pitches) and follow progress. They can't edit or delete existing sets, change team or roster settings, or see other pitchers. Coaches manage the team.
  • [Lawyer to confirm the age rules, and whether a parent must approve a login for players aged 13–17.]

3. Your responsibilities as a coach

  • You must have permission from each pitcher's parent or guardian before entering a minor's name and pitch data, turning on a share link, or inviting a player to log in. Rise asks you to confirm this when you add a pitcher and records it, but a coach can't give consent for a family: your confirmation is a temporary record that lasts 30 days. If no parent has given consent in Rise by then, sharing and new invites pause for that pitcher until a parent does. Some features (logins for players under 13) need a parent's own consent and approval. Parents can withdraw consent at any time; that pauses new tracking (by coaches and families, including bullpens, live logging and game imports), sharing, invites and under-13 logins for that pitcher. Existing data stays visible to the coach and isn't deleted.
  • Share links are off until you turn them on. Keep them private and send them only to the right people. Anyone with a link can see that pitcher's progress page, including full history. You can turn a link off at any time.
  • Keep your login secure. You're responsible for activity on your account and team, Each team has one coach account. Don't share your login with other coaches.
  • Only invite parents to their own child's pitcher.

4. Acceptable use

Don't use Rise to break the law, harass anyone, upload content you don't have the rights to (such as a logo you can't use), try to access other teams' data, or disrupt the service.

5. Plans and payments

  • Free: one coach, up to six active pitchers, the last 30 days of history in the coach's own views, a parent share link that shows full history, and readiness tips for newer pitchers (Levels 1–3).
  • Rise Team: $99 per team per season, or $12 a month, plus applicable tax. It adds no pitcher cap, team logo and colors, parent logins (at-home bullpens and progress) and player logins by invite (under 13 or no birth date requires a linked parent's consent and approval of that login), the readiness score (Level 4 and up), full history in coach views, and pitcher comparison (fatigue resistance). Rise Team is still one coach per team.
    • Season ($99): a one-time payment covering 6 months from purchase. It does not renew automatically. We'll email the team owner 2 weeks before it ends.
    • Monthly ($12): renews automatically every month until cancelled. You can cancel any time in Settings → Plan → Manage plan. Access continues to the end of the paid month.
    • Switching: you can switch between season and monthly only at renewal, with no proration.
  • Early teams: teams that existed when Rise Team launched keep everything they had, free, through June 30, 2027. On July 1, 2027, they move to the Free plan unless they've bought Rise Team. Their data is kept. If an early team buys Rise Team before July 1, 2027, its paid time starts on the day it buys.
  • Payments are processed by Stripe, and Stripe's terms also apply to your payment. Prices are in US dollars. Listed prices don't include tax. Applicable sales tax is calculated by Stripe and added at checkout, and shown before you pay.
  • Refunds follow our Refund Policy. Season payments can be refunded within 14 days of purchase.
  • Price changes: we may change prices for future purchases or renewals. We'll tell you before a change affects your plan, and it won't change a season you've already paid for.

6. When a plan ends

If Rise Team ends (cancelled, not renewed, refunded, or a failed payment that isn't fixed), the team moves to the Free plan's limits. We don't delete your data.

  • Pitchers beyond six become read-only until you upgrade or choose which six stay active.
  • Parent and player logins are paused.
  • Coach views show the last 30 days.
  • Everything comes back if you upgrade again.

7. Your content

You own the data and content you put into Rise (names, pitch data, logos). You give us permission to store, process and display it only to run Rise for you. This includes sending pitch data, notes and uploaded stat sheets through our app platform's AI service to produce tips and summaries, and showing pitcher pages to people you share them with.

8. AI output, readiness and fatigue numbers

AI-generated tips and summaries, readiness scores, fatigue resistance and other numbers in Rise are informational only. They're based on the data you log or upload, they can be wrong, and they're not medical advice. They don't replace a coach's judgment or a doctor's advice about pitch counts, rest, pain or injury.

9. Availability and connection

Rise needs an internet connection to load and save data. If the signal drops during a bullpen, the bullpen in progress is kept in your browser on that device until you save with a connection. Data that's only on a device that's lost, or whose browser data is cleared before saving, may not be recoverable. We try to keep Rise running and your data safe, but we can't promise it will always be available or error-free.

10. Ending your account

You can stop using Rise and delete your account at any time. We may suspend or close accounts that break these terms. If we close Rise entirely, we'll give reasonable notice and a way to get your data [and a prorated refund of any unused paid time: decide].

11. Disclaimers and limits

Rise is provided "as is." To the extent the law allows, we aren't liable for indirect or consequential damages. Our total liability to you is limited to the amount you paid us in the 12 months before the claim. [Lawyer to review this section.]

12. Governing law

These terms are governed by the laws of [STATE], and disputes will be handled in the courts of [COUNTY, STATE]. [Lawyer to review.]

13. Changes to these terms

We'll post changes here and update the effective date. For important changes, we'll tell coaches by email or in the app before they take effect.
